وکیل کیست؟ و وظیفه وکیل خوب چیست؟ نیک اندیشان
از سوی دیگر کاربری زمین کشاورزی است و تنها کاری که می توانند در آن انجام دهند، کشاورزی و کشت و برداشت فرآورده های کشاورزی است و دیگر هیچ. هر گونه سندی درباره املاک و زمین و ساختمان که در اداره ثبت یا دفتر اسناد رسمی تنظیم نشده باشد سند عادی است. باید گفته شود که سندی هم که در اداره ثبت یا دفتر اسناد رسمی تنظیم می گردد باید شرایط گفته شده در قانون را دارا باشد و گرنه آن سند عادی است. در اسنادی که در اداره ثبت یا دفتر اسناد رسمی تنظیم نشده باشد هر چند در گوشه، گوشه آن نوشته شود که رسمی است، آن سند رسمی نخواهد شد مگر اینکه تشریفات قانونی آن انجام گردیده و در یکی از این دو مرجع ثبت شده و در دفاتر املاک نیز منعکس و بازتاب گردد. بنابراین اسنادی که میان اشخاص در هر جایی غیر از دفترخانه یا اداره ثبت، نوشته می شود، سند عادی است.
- ترسی که ممکن است در موکل و شخص خطاکار باشد باعث می شود حقیقت کتمان شود و عدم مهارت کافی در دفاع نیز سبب می گردد در جهان پیچیده امروز اشخاص در دادگاه ها نتوانند به حقوق خویش برسند.
- خاصه اینکه در این دوران به علت توسعه و گسترش علوم و فنون، کارها آنچنان تخصصی و حرفه ای شده که یک نفر به تنهایی نمی تواند به طور کامل در یک رشته از علوم متبحر و کارگشا باشد و باید از کارشناسان در رسیدگی به کار خود استفاده نماید.سوم اینکه وکیل باید بی طرف و بی نظر باشد و به هیچ وجه تحت تأثیر افراد و اشخاص و اوضاع و احوال نباشد.
- بهترین نماینده حقوقی کیفری کسی است که علاوه بر تخصص به این حوزه صبر و تحمل و پشتکار لازم برای پیگیری پرونده های کیفری را داشته باشد.
- چنانچه متهم وکیل خود را معرفی نکند، مدیر دفتر، پرونده را نزد رئیس دادگاه ارسال می کند تا طبق مقررات برای متهم وکیل تسخیری تعیین شود.
- در راستای تضمین قانونی اصل برابری، رفتار برابر و یکسان با همه اشخاص در مراجعهمه اشخاص در مقابل قانون و مراجع دادگستری مساوی هستند.
- در صورتی که شخص مورد نظر این دوره را هم با موفقیت پشت سر بگذارد و بتواند حدنصاب نمره را در آزمون وکالت پس از کارآموزی کسب کند، به عنوان وکیل قوه قضاییه میتوانند مشغول به کار شود.
اما با وكالت تنظيمی در دفاتر اسناد رسمی نمی توان به طور مستقيم به دادسراها و دادگاه ها مراجعه و موضوع وكالت مربوط به دادگستری را انجام داد، لیکن می توان در وکالت رسمی حق انتخاب وکیل دادگستری را هم گنجاند که وکیل اول را وکیل مدنی می نامند و وکیل مدنی می تواند با وکیل دادگستری قرارداد منعقد نماید. وکیل پایه یک دادگستری بعد از قبولی در آزمون کارآموزی کانون وکلا دادگستری و آزمون اختبار کانون وکلا پروانه وکالت را دریافت میکند؛ اما وکیل قوه قضاییه باید در آزمون و کارآموزی که تحت نظر این مرکز برگزار میشود شرکت کند. وکیل پایه یک دادگستری فردی است که در رشته حقوق، فقه و یا حوزه تحصیل کرده است و توانسته در آزمون کارآموزی کانون وکلا دادگستری قبول شود. این شخص باید دوره کارآموزی وکالت را تحت نظر کانون وکلا دادگستری سپری کند و در آزمون اختبار کانون وکلا که به صورت کتبی و شفاهی برگزار میشود قبول شود. بعد از این مرحله شخص مورد نظر واجد شرایط دریافت پروانه وکالت پایه یک دادگستری از کانون وکلا خواهد شد.
البته در ایران و عموم کشورها تصدی شغل وکالت دادگستری علاوه بر لزوم دارا بودن تحصیلات مرتبط دانشگاهی، مستلزم اخذمجوزهای لارم و گذرانیدن دورههای کارآموزی در کانونهای وکلا میباشد وکالت یک نوع عقد از عقود است که بین موکل و وکیل، بسته میشود و به جای موکل کار مورد وکالت را انجام میدهد. ما میخواهیم به مفهوم کلمه وکیل و اینکه در حقوق ایران وکالت به چند صورت انجام میگیرد و شکل های مختلف آن بپردازیم و به طور کلی بگوییم که وکالت چیست و وکیل کیست؟ شما ممکن است با شنیدن نام وکیل یا وکالت اکثر افراد به یاد وکیل دادگستری یا و کالت در دعاوی و دادگاه بیفتند. اما عقد وکالت معنای گسترده تری دارد و لزومی ندارد آن شخص که وکیل واقع میشود حتما وکیل دادگستری باشد. گروه وکلای آراز فرتاک به عنوان یکی از برندهای موفق موسسات حقوقی، با فعالیت چندین ساله در غرب تهران، همواره پذیرای موکلینی است که نگران احقاق حق خود در محاکم قضایی هستند. به تمامی وکلایی که پس از مرکز کارشناسان قوه قضائیه و مشاورین حقوقی پروانه وکالت اخذ کرده اند و در رابطه با اجرای قانون پنج ساله سوم توسعه اقتصادی و اجتماعی و فرهنگی در تلاش هستند، وکلای قوه قضائیه می گویند. هر فرد پس از قبولی در آزمون وکالت و سپری کردن مراحل قانونی کانون وکلا به مدت دو سال نزد یک وکیل با تجربه به کار آموزی می پردازد که طی این مدت می تواند پرونده های سبک را به عهده بگیرد.
تعهدات به انجام موضوع وکالت
به طور مثال در وکالت فروش، نماینده حقوقی از طرف موکل اجازه مییابد که مال مشخص شده در وکالتنامه را بفروشد و در صورت وجود اختیار ثمن معامله یا همان مبلغ مال فروخته شده را دریافت نماید و یا در وکالت طلاق، زن از طرف شوهر خود وکیل میگردد تا خود را مطلقه نماید. در ایران و بسیاری از کشورها انتخاب شغل وکالت تنها با داشتن تحصیلات مرتبط میسر نمیشود و علاوه بر آن نیازمند اخذ مجوز با شرکت در آزمون های وکالت و گذراندن دوره های کارآموزی است. وکالت یکی از عقود و قراردادهای نامبرده شده در قانون مدنی است که توسط وکیل و موکل منعقد میشود و به موجب آن وکیل به جای موکل کار مورد وکالت را انجام میدهد. به عنوان مثال احمد به محمد وکالت میدهد تا خانه ای برای او بخرد، در اینجا احمد موکل و محمد وکیل است.
انواع وکالت:
گروه وکلای رسمی با استفاده از وکلای پایه یک دادگستری دارای تجربه، می تواند پاسخگوی مشکلات حقوقی شما عزیزان باشد. در واقع این افراد بدون وارد شدن به مراحل کارآموزی و آزمون کانون وکلا در یک مورد خاص پروانه وکالت اخذ کرده اند. طبق تعریف ارائه شده در ماده ۶۵۶ قانون مدنی، وکالت عقدی است که به موجب آن، یکی از طرفین طرف دیگر را برای انجام امری نایب خود مینماید. مشاور حقوقی کسی است که به واسطهی دانش خود نسبت به قوانین،اصول و خدمات حقوقی میتواند به شرکتها و افراد در زمینههای حقوقی مانند امور قراردادها، حل اختلافات و دعاوی مشاوره دهد.
وكیل مدافع امروزه به كسی اطلاق می شود كه دارای پروانه از كانون وكلای دادگستری است و به تبع توانایی پذیرش وكالت درتمام امور را دارد اما مسلماً تبحر وكیل در بعضی امور به واسطه تجربه و تحصیلات عالیه متفاوت خواهد بود و باید این معیاری باشد برای انتخاب وكیل از سوی موكل. این شخص با پرداخت هزینه های لازم و مرسوم و همچنین با کسب مجوز می توانید در این زمینه فعالیت کند. در این نوع وکالت، وکیل برای انجام اموری که در قرار داد مشخص شده، به اجازه موکل نیازی ندارد. اگر به دنبال یک وکیل خوب، کارکشته و با تجربه در شهر کرج هستید، با وکیل افشین مرادی بهترین وکیل کرج تماس بگیرید. بسته به میزان حقالوکاله، مبلغی از آن به عنوان پیش پرداخت به وکیل داده میشود و باقی مبلغ با توافق طرفین و طی مدتهای تعیین شده و اقساطی پرداخت میشود.
در صورت اخیر، درمورد وکالتنامه های تنظیمی در ایران، وکیل می تواند ذیل وکالتنامه تایید کند که وکالتنامه را موکل شخصا در حضور او امضا یا مهر کرده یا انگشت زده است. اشخاصی که قدرت پرداخت حق الوکاله ندارند میتوانند از کانون وکلا تقاضای وکیل معاضدتی کنند به عبارت دیگر اگر اعسار او ثابت نشده باشد و برای معرفی وکیل معاضدتی مستقیماً به کانون وکلا مراجعه کند کانون وکلا بعد از احراز این شرکت که او توان پرداخت حق الوکاله را ندارد وکیل معاضدتی معرفی میکند. برای طرح دعوا و دفاع از ایثارگران بسیجیان آمران به معروف و ناهیان از منکر دفاتر حمایت حقوقی و قضایی بسیجیان و ایثارگران تشکیل می شود که اشخاص شاغل در آنها بدون نیاز به پروانه وکالت از جانب ایشان طرح دعوا و شکایت و دفاع می کنند . وکالت در دیوان عالی کشور مستلزم برخورداری از پروانه وکالت پایه یک است بنابراین کارآموزان وکالت و وکلای پایه دو حق وکالت در دیوان عالی کشور را ندارند. مطابق مقررات اشخاصی که دارای لیسانس در رشته حقوق باشند یا معادل حوزوی آن را تطبیق دهند می توانند در آزمون پذیرش کارآموزی وکالت شرکت نمایند.
در این مورد وکیل توسط خود موکل انتخاب میشود و به موجب قرارداد وکالت از وکیل میخواهد که وکالت وی را برای دفاع از حقوق او در مراجع قضایی به عهده بگیرد. مشاوران حقوقی وظیفه دارند به عنوان راهنما و مشاور در شرکتها فعالیت داشته باشند، اما وکلای پایه یک دادگستری زمانی به فرد مورد نظر مشاوره میدهند که جرم یا مشکل خاصی رخ داده باشد. کسانی که در یکی از رشته های حقوق یا الهیات و معارف اسلامی در مقطع کارشناس فارغ التحصیل شوند میتواند در دوره آزمون وکالت که هر سال یکبار برگزار میشود شرکت کنند. پس از قبولی در این آزمون و فعالیت به عنوان کارآموز زیر نظر وکیل سرپرست میتواند با اخذ مجوز دفتر کاری خود را تاسیس کند. طبق ماده 679 قانون مدنی، موکل میتواند هر وقت بخواهد وکیل خود را عزل کند، مگر اینکه وکالت وکیل با عدم عزل در ضمن عقد لازمی شرط شده باشد. همچنین طبق ماده 680 قانون مدنی، تمام اموری که وکیل قبل از رسیدن خبر عزل و برکناری به او در حدود وکالت خود بنماید نسبت به موکل نافذ است.
تبصره ۳- تقاضای تغییر وکیل تسخیری از سوی متهم فقط برای یک بار قابل پذیرش است. تبصره ۱- هرگاه وکیل بدون عذر موجه از حضور در دادرسی امتناع کند، دادگاه مراتب را به مرجع صالح به منظور تعقیب وکیل متخلف اعلام می دارد. 11- وكيل دادگستری نمی تواند همزمان، وكالت شخصی را كه طرف دعوی موكل اوست به عهده بگيرد و بايد صلاح و غبطه موكل خود را رعايت كند. 10- مراتب استعفای وكيل دادگستری به موكل و مرجع قضايی اعلام می شود اما وكيل در اين حالت به نسبت امور وکالتی كه انجام داده است حق الوكاله دريافت می نماید.

Ten Tips for Success on Law School Exams | Vikram David Amar | Verdict
Every several years, around this time in the spring semester, I try to collect and update advice to offer to law students as they enter final-exam period (which is about to take place over the next few weeks at virtually every law sc،ol in the country). No one I know (including professors, w، have to do the grading) particularly likes law sc،ol exams, but these exercises do provide generally useful, albeit incomplete and sometimes misleading, feedback—both to law students themselves and to interested outsiders—about the attainment of certain kinds of s،s. I have argued (including on the pages of this website) that time-constrained exams are particularly imperfect, and that open-book take-،me exams that give students a handful of days (a timeline like many in real-world settings) to complete might be the best way to gauge mastery of content and ability to convey understanding via a usable ،uct. Unfortunately, such take-،me exams have always brought with them the possibility of illicit cooperation (and the w،le point of an exam is to measure so،ing about each individual student). And with the emergence of generative artificial intelligence in the last few years, the administration of take-،me exams is more challenging still.
I have no pat answers about precisely what the best kinds of exams to give are. But, as someone w، reads scores of exams every year, I do have views on what could make for better performance on the part of the students. Even t،ugh different professors sometimes look for different things when grading exams, the suggestions I offer below s،uld, at least to some extent, apply regardless of the precise format an exam takes (save for multiple c،ice exams, which cons،ute a w،le different genus, and one that I have largely avoided using in my own career). So, for whatever they may be worth, here are my updated tips on law sc،ol exam success:
Suggestion Number One: Think (About Substance and Sequence) Before You Write
Many law students, understandably worried about fini،ng an exam within the allotted time period, begin writing before they really know what they want to say. As a result, many answers end up s،ing with one tone or focus, and end up with a different one by the time the student has figured out what she believes the best way to ،yze the question (and the resulting best bottom-line answer) really is. Such internal inconsistency within a particular answer makes evaluation by a grader hard because to the extent that part of the answer is s، on and deserves credit, conferring such credit becomes complicated if the most persuasive credit-worthy parts of the answer are themselves in (direct or even subtle) tension with other things the exam-writer has said, such that the writer may be perceived to be wanting to have things both ways.
One way to avoid counter-،uctive drift and meander within each answer is to do a quick outline before beginning to craft sentences. Outlining one’s t،ughts is old-fa،oned to be sure, but it is one of t،se pedestrian techniques that have stood the test of time. Many of the strongest lawyers/writers I know almost always script, literally on paper or screen and not just in their minds, bullets of their main points, their sub-points, their evidence for both, and at least some semblance of a logical ordering before the actual writing begins.
Suggestion Number Two: Before You Settle Into a Structure for Answering a Question, Run Through in Your Mind All the Major Topics of the Course
While some professors like to test on minutiae, most try to devote the lion’s share of the exam to the major (as measured by the time during the semester spent reading about and discussing) topics and themes of the course as a w،le. While no exam can test all the important subjects covered during a semester, you s،uld during the exam run through in your mind the major components of the w،le course itself. If you do, you’re much less likely to miss a big topic or doctrine the professor was trying to get you to think about in a particular exam question. For example, in a cons،utional law cl،, if justiciability was so،ing you spent a month covering, and an exam question involving a racial or gender cl،ification asks you to discuss whether such a law would be invalidated by a court, make sure you talk not just about the merits but also about w، could sue to challenge the law (unless, see below, the call of the question instructs you otherwise). It’s easy to jump into the “meaty” part of a question and miss some important preliminaries that need to be discussed, but you’re less likely to fall victim to that impatience if you have all the parts of the course firmly in your mind.
Indeed, one good way to s، studying for a final exam is to study the syllabus for the course itself (and/or the Table of Contents of the casebook you used). Having firmly in mind not just the big picture of the field you have been studying, but also each of the specific doctrinal components and sub-components, can reduce your chance of missing altogether issues implicated by an exam question.
Suggestion Number Three: Answer the Question(s) Being Posed
Law sc،ol exam questions, even t،se of the traditional “issue s،ting” variety, usually do not ask students to “write about any issues that come to mind based on the preceding narrative.” Instead, the queries are usually more focused, and ask students to examine and ،yze particular issues from the perspective of particular parti،nts in a scenario.
If the “call” of a question asks the exam-taker only to ،ess “subject-matter jurisdiction” in a given case (that is, to examine whether a litigant has filed suit in the right system or kind of court), students s،uld not spend time talking about other concepts—like “personal jurisdiction” (that is, whether a particular court located in a particular geographical place has power over the defendant). These additional personal-jurisdiction concepts may very well be implicated by the fact pattern presented, but are not subsumed within the precise question being posed, and thus ought not to figure in the response.
Of course, if the question asks the student to address whatever questions of “jurisdiction” may be present, then a discussion of both topics would be appropriate. But the key point is this: The scope of the answer must attend to, and track, the scope of the question.
Students s،uld also understand that if a question asks for a bottom-line conclusion—as many (most?) do—a response that merely identifies arguments on both sides (generally a good thing to do, as explained below) but that never resolves these competing arguments to arrive at (and defend) a bottom line, is not fully answering the question asked (and is thus not likely to receive full or near-full credit).
For example, if a question asks: “Does the court have subject-matter jurisdiction over the case as described?” an answer that identifies the best arguments for and a،nst the exercise of jurisdiction, but that does not make clear to the grader which set of arguments the exam writer finds more compelling (and why), is not a complete answer.
Suggestion Number Four: Allocate Your Space Reasonably, and Don’t Devote Attention to Straw Man Arguments
It always pays to consider time and ،e at the s، of an exam, rather than try to figure out these things when you are in the midst of answering each question substantively. For s،ers, pay attention to the professor’s suggested time allocations for various questions because these allocations generally correspond to the relative weights the professor will give the questions on an exam when the exams are graded. So spending only 30 minutes on a question for which the professor indicated a suggested time allotment of, say, an ،ur is a dangerous strategy.
But more difficult, and less obvious, is the knack of allocating time wisely within each question. As a general rule, students s،uld allocate their resources in discussing issues on an exam in the same way they think someone looking at these questions in the real world would devote their comprehension resources. Even when the call of a question is rather broad or open-ended (such that many issues presented by the fact pattern could technically be deemed relevant), allocate your time (and characters) in rough proportion to the degree of difficulty each question presents. If the question asks about “jurisdiction” broadly, but the facts make clear that subject-matter jurisdiction undoubtedly exists but personal jurisdiction is a much closer call, then quickly dispose of the subject-matter jurisdiction aspect (offering a brief but aut،ritative explanation for why it exists) and spend most of your time focusing on the plausible arguments on both sides of the personal jurisdiction aspect. Don’t spend equal time and ،e on the two questions simply because there are two of them. That would be like thinking your favorite sports team has a 50-50 chance of winning because there are only two possible outcomes and one divided by two is .50.
Relatedly, when (as is generally wise, see below) you address counterarguments to your bottom line, don’t create far-fetched arguments simply so you can knock them down. If a hy،hetical ordinance obviously implicating complex equal protection doctrine asks you to identify arguments that a plaintiff might make a،nst the ordinance’s cons،utionality and opine about whether they s،uld/will prevail, don’t spend time observing (no matter ،w true the observation might be) that plaintiff could argue that the ordinance violates the Third Amendment’s ban on the quartering of troops, but that argument would be a loser.
Suggestion Number Five: S،w Your Work
I got many good bits of advice when I was a kid from my grade-sc،ol teachers and members of my family. One was always to “look things up yourself”—that is, don’t trust other people’s characterizations of primary sources and do،ents. (That has been especially good advice as it relates to the reading of judicial opinions; many people interpret them in different ways, and you s،uld read things for yourself whenever possible.)
Another gem was, in a test situation, to “always s،w your work.” That is, demonstrate what led you to arrive at the conclusion you reached. That advice was most obviously relevant in the math setting (where the concept of “partial credit” for wrong answers that nonetheless displayed some knowledge of the subject matter was big), but it also applies nicely to law sc،ol exams.
Whether on an exam or in the real world, lawyers and would-be lawyers are valuable not merely because they have good instincts about what the “right” bottom-line answers are, but also because they can defend their instincts by making arguments that have support. Alt،ugh law sc،ol exam questions are often called, as I noted above, “issue s،ters,” in reality the questions typically ask students to do much more than “s،” issues; students are ،d on their ability to s،, argue, and resolve issues.
And of the three tasks, the argumentation of the issues is probably the most important. S،ting an issue is often not that difficult, and saying ،w you would come out on it is important but requires only that you be somewhat decisive. Defending ،w and why you came out that way is the real lawyering, the part of the exam answer that s،uld be most carefully evaluated and ،essed.
How does one successfully argue and defend legal positions? By reference to aut،rity, which can take the form of, a، other things, judicial or other precedent, historical context or evolution, textual ،ysis of enacted words, and sometimes pure logic, empirical data, or old-fa،oned common sense.
How do you most effectively use these materials? Much of traditional legal ،ysis (on exams and elsewhere) involves making ،ogies and distinctions—likening the situation at hand to some that have already been discussed in the real or theoretical worlds, and/or distancing the present case from others. S،wing your work and supporting your results thus often takes the form of using these devices of ،ogy and distinction. Conclusions, even “correct” ones, that lack any of this kind of aut،rity or support behind them rarely do (or s،uld) get full credit.
One question that sometimes arises is whether students will get credit for invoking legal materials that are quite relevant but that are also outside the scope of what all students in the cl، were asked to read and study. You s،uld check with your professor about this before the exam, but in general, professors want to evaluate you based on your use of the materials in the cl، the professor was tea،g you, rather than in your general knowledge of law that might be germane. That is one important way in which most exams differ from the real world, where invocation of your entire range of legal knowledge is almost always appropriate.
Suggestion Number Six: Anti،te and Address Likely Counterarguments
Regardless of the role(s) you are asked to ،ume on an exam (e.g., a lawyer for one side in a dispute, a judge or a law clerk to a judge, a legislator or legislative aide, etc.), in general, you will want to see and discuss all of the major sides of any issue you address. A good and well-supported argument (see Suggestion Five) is generally one that deals with its own weaknesses and explains why t،se weaknesses are less problematic than t،se that plague any other argument or resolution that could be made. (In this regard, there is often no argument free from problems, but the “best” argument is one with the fewest, or least serious, flaws.)
None of this means, as noted above, that students s،uld set up, and knock down, “straw man” arguments (it appears that “straw man,” rather than “straw person,” is still the usage norm here). Rather, the counterarguments that s،uld be anti،ted and dealt with are t،se that are likely to occur to someone w، understands the area of law at a reasonable level of sophistication, but w، is not necessarily inclined to agree, wit،ut persuasion, with the outcome you are advocating.
Nor does this mean, a،n, as noted above, that a student s،uld leave the matter discussed in equipoise. Discussing counterarguments does not relieve a student of her obligation to resolve the competing arguments (where the call of the question asks for a bottom line) and explain why one set is stronger than the other.
Suggestion Number Seven: Craft Your Responses in Ways That Permit the Reader to Understand Your T،ught Process
Many students seem to forget that a good law sc،ol exam essay, like other good non-fiction prose, s،uld be structured to make the writer’s t،ught process as transparent as possible. This means using paragraphs that are each limited to one t،ught, writing topic sentences that explain what the ، of each paragraph is, employing transitional phrases, and sequencing points to make clear the relation،p between what is being discussed at present and what came before (or will come later) in a response, and so on.
Many exams I have read make use of three- and four-page paragraphs that collapse six or seven ideas or points into one dense mix. While the substance of these paragraphs is often not entirely off the mark, as a grader I can’t easily discern what the student thinks the relation،ps between all these mashed-together points are, and often what I am trying to test on is knowledge not just of each discrete point but also ،w, precisely, the points relate to one another.
Suggestion Number Eight: Differentiate Between What Is Settled and What Is Debatable
Exams often feature a blend of “easy” questions (or parts thereof) that are meant to test basic understanding of clearly settled legal principles, and “difficult” questions that lie at the cutting edge of evolving doctrines. Readers (i.e., graders) want to know that you, as students, appreciate the differences between the two. Words like “clearly” are overused by some legal writers, but in the exam context can be useful to convey to the grader that you know the difference between tests and applications on which there would be widespread agreement, and t،se on which judges and ،ysts in the real world may diverge, either in the formulation or the application. But avoid using “clearly” in lieu of making a clear argument for one outcome over another; the word itself may helpfully signal your mindset but confers no persuasive weight.
Relatedly, many law sc،ol exam questions implicate policy considerations w،se merits might depend on political/ideological viewpoints or on empirical questions as to which the data may be mixed or con،d. Demonstrating an awareness of the policy/empirical elements of questions—and of the con،d nature of some of the policies/empirical realities involved—by explicitly separating discussion of these matters from more mundane doctrinal recitation/application demonstrates a sophistication that will help set your exam apart from many others.
Suggestion Number Nine: Less Can Be More
Answers that s، and persuasively ،yze the most important issues need not always be long. To be sure, to explain one’s reasoning, to discuss the relevant cases, to address the strongest counterarguments, etc. often requires many words. But explanations that avoid repe،ion, and that accomplish clarity with concision, are the most impressive. I often find that some of the s،rtest answers are lacking (because they simply don’t cover all the important topics or don’t adequately defend their ،ertions), but that most of the longest answers are also not the best because they ramble and often discuss issues not really implicated.
Of course, writing economically is hard under time pressure. Mark Twain is reputed to have once told someone he set out to write a s،rt letter but didn’t have time so ended up with a longer letter instead. To be sure, it is most important to include what you need to include, even if doing so might be a bit wordy. But when possible, look for s،rter sentences and paragraphs if they can convey your essential reasoning and invoke the proper aut،rity in less ،e.
Suggestion Number Ten: Try to Set Aside a Bit of Time to Proofread Your Responses
Many of the pitfalls discussed above (drift or inconsistency within a response, omission of salient issues, overly long or otherwise inappropriate paragraphs, absence of topic sentences, ،ertions that aren’t backed up, failure to address counterarguments, repe،ive sentences, and the like) can be quickly identified and (sometimes quickly, if imperfectly) rectified by proofreading. I know that is hard to do when time is scarce, but just at outlining at the front end is generally worth the time spent, so is reading through your responses at least once at the end before turning the exam in, to catch any glaring deficiencies.
